Michigan Amazon FBA sales tax is relatively straightforward on rate: Michigan applies a single statewide 6% sales and use tax rate, with no city, county, or other local sales taxes. The more important question for an FBA seller is who has the collection and filing responsibility. For sales made through Amazon’s marketplace, Amazon generally acts as the marketplace facilitator and is required to collect and remit Michigan tax on taxable facilitated sales.
That does not mean every Amazon FBA business can ignore Michigan compliance. Inventory held in a Michigan fulfillment center can create physical-presence nexus, and your direct Michigan sales, inventory position, exempt sales, and other selling channels can change whether you need a Michigan registration and returns. Sales Tax Compliance USA is a done-for-you service staffed by people: we review the facts, register and file where required, and help keep marketplace-collected sales separate from sales you must report yourself.
When Michigan sales tax nexus starts
Nexus is the connection that allows Michigan to require a seller to register, collect, file, and remit sales or use tax. The Michigan Department of Treasury recognizes both physical and economic nexus. Physical nexus can arise when a seller owns, rents, leases, maintains, or has the right to use tangible personal property physically located in Michigan, or maintains or uses a warehouse, distribution facility, storage place, office, or similar place in the state to facilitate sales or delivery.
A remote seller has Michigan economic nexus if, in the previous calendar year, it had gross sales exceeding $100,000 or 200 or more separate transactions into Michigan. Both taxable and nontaxable sales count toward those tests. Michigan states that a seller meeting either prior-year threshold must register, collect, and begin filing in the following calendar year, subject to the special marketplace-facilitator rules discussed below.
Physical nexus works differently from the prior-year economic-nexus measurement. If your merchandise is placed in Michigan through an FBA fulfillment arrangement, the exact start of your obligation depends on the inventory facts and sales channels. Do not assume that marketplace tax collection eliminates every registration or reporting issue; have the Michigan facts reviewed before deciding not to register.
Does Amazon FBA create Michigan sales tax nexus?
It can. Michigan treats a seller as having nexus when it owns, rents, leases, maintains, or has the right to use tangible personal property that is permanently or temporarily physically located in Michigan. Michigan also identifies maintaining, occupying, or using a warehouse, distribution facility, storage place, or similar location to facilitate delivery or sales as a nexus-creating activity.
For an FBA seller, inventory stored in a Michigan fulfillment center can therefore create physical-presence nexus even if the business is organized and operated outside Michigan. The relevant issue is the presence of your inventory in Michigan, not whether you personally operate the building. Michigan’s guidance says that physical-presence nexus continues from the date of contact for the remainder of that month and the following 11 months.
Amazon’s marketplace collection obligation is separate from your nexus analysis. A marketplace may collect and remit tax on its facilitated transactions, while you may still need to assess registration, direct sales, non-marketplace activity, and any returns required by the Michigan Department of Treasury. We can review inventory-location and sales-channel records to determine the practical compliance steps.
When you need a Michigan sales tax permit
Michigan calls the authorization to collect sales tax a sales tax license. The Michigan Department of Treasury says businesses must register with Treasury to receive one. The exact position here depends on your own facts, so it is worth confirming with the state directly or talking to us about your situation.
If you have Michigan nexus and make direct retail sales that you must collect and report, a Michigan registration is generally required. This can include a seller with inventory in Michigan that also sells through its own store, wholesale arrangements that include taxable retail transactions, or another non-marketplace channel. Registration should be addressed before you begin collecting Michigan sales tax directly from customers.
There is an important marketplace-only exception. Michigan states that a marketplace seller making only facilitated sales, and no direct sales, should not register for sales or use tax and has no filing obligation when the marketplace facilitator is required to register and remit on the seller’s behalf. If your facts are mixed, do not apply that exception automatically: direct sales and marketplace sales must be reviewed separately.
Michigan marketplace facilitator law and Amazon sales
Michigan marketplace facilitator law places the tax collection and remittance responsibility on a qualifying marketplace facilitator for taxable sales it facilitates to Michigan purchasers. A marketplace facilitator is a person that facilitates retail sales by listing or advertising tangible personal property or taxable services for marketplace sellers and, directly or indirectly, collects customer payment and transmits it to the marketplace seller for consideration.
For Amazon marketplace sales, this means Amazon generally collects and remits Michigan sales tax on taxable facilitated transactions. A marketplace seller should not report sales made through a marketplace facilitator on its own Michigan return. This answer addresses marketplace-facilitated sales; it does not automatically cover sales made through your own website, manual invoices, another direct channel, or transactions the marketplace does not facilitate.
Marketplace sales still matter when measuring economic nexus. Michigan requires marketplace sellers to include both their direct Michigan sales and sales completed through marketplace facilitators when calculating the prior-year economic-nexus thresholds. The threshold test and the responsibility to report a particular marketplace sale are related but not identical questions.
What Michigan sales tax rate applies to FBA sales?
Michigan’s statewide sales tax rate is 6%. Michigan has no city, county, or local sales tax. For a taxable FBA sale delivered to a Michigan customer, the absence of local rates means there is no local rate lookup or jurisdiction-by-jurisdiction tax calculation layered on top of the statewide rate.
The same statewide structure applies to Michigan use tax, which is complementary to sales tax. Michigan use tax can apply to taxable property purchased without Michigan sales tax and used, stored, or consumed in the state. For a seller with collection responsibility, the practical task is to determine the correct tax type and reporting treatment based on the transaction and where ownership transfers.
A flat state rate does not make every product taxable. Rate is only one part of compliance. Product taxability, properly supported exemptions, the marketplace facilitator’s collection, and whether the seller has direct sales all need to be handled correctly.
Which Amazon FBA products are taxable in Michigan?
Michigan generally taxes retail sales of tangible personal property unless a specific exemption applies. Most physical products commonly sold through FBA fall within that general rule. Michigan defines tangible personal property broadly as property that can be seen, weighed, measured, felt, or touched, and includes items such as electricity, water, gas, steam, and prewritten computer software.
Exemptions depend on the item, purchaser, or use of the item. Michigan identifies exemptions that can include purchases for resale, qualifying agricultural production, qualifying industrial processing, and certain sales to government entities and qualifying nonprofit organizations. Michigan also generally exempts food and food ingredients, subject to the applicable statutory conditions. An exemption should not be claimed merely because a product category sounds similar; the specific product and purchaser facts matter.
If a buyer claims an exemption on a direct sale, retain the required exemption documentation. Michigan’s return instructions state that a Michigan Sales and Use Tax Certificate of Exemption must be obtained from the purchaser when applicable. For marketplace sales, confirm the marketplace’s tax treatment and reports, but do not report facilitated sales yourself merely because tax was not charged on a transaction that may be exempt.
When you must collect Michigan sales tax
You must collect Michigan tax on taxable direct retail sales when you have a Michigan collection obligation. That can arise through physical nexus, including inventory located in Michigan, or through economic nexus based on the prior calendar year’s Michigan sales or transaction volume. Michigan’s economic-nexus test counts gross sales and transactions whether taxable, nontaxable, or exempt.
For a seller that crossed an economic threshold during a calendar year, Michigan directs the seller to register and be prepared to collect and file in the following tax year. A remote seller that meets the economic threshold but makes only nontaxable sales, such as a pure wholesaler that makes no retail sales, is not required to register or file solely for that reason.
For taxable sales facilitated by Amazon’s marketplace, the marketplace facilitator is the party expected to collect and remit under Michigan’s marketplace rules. You should distinguish those sales from direct sales rather than collecting duplicate tax or including facilitator-collected sales in your own reporting. A person on our team can reconcile that distinction with your sales and inventory records.
Michigan sales tax filing, remittance, and deadlines
Michigan assigns direct registrants a monthly, quarterly, or annual filing frequency based on the taxpayer’s level of activity and tax liability. The Michigan Department of Treasury determines the frequency each year. Returns and payments can be filed and paid electronically through Michigan Treasury Online.
Monthly returns and payments are due on the 20th day of the following month. Quarterly returns and payments are due on the 20th day of the month after the quarter ends: April 20 for the first quarter, July 20 for the second, October 20 for the third, and January 20 for the fourth. Annual filers are due February 28 of the following calendar year. If a due date falls on a weekend or Michigan state holiday, the due date moves to the next business day.
All direct Michigan filers must submit an annual return by February 28, even when assigned monthly or quarterly filing. Michigan also may require accelerated payments for taxpayers subject to that requirement: a prepayment is due by the 20th of the current month, followed by a reconciliation payment by the 20th of the following month. Your assigned account instructions control, so review notices from the Michigan Department of Treasury rather than assuming a payment schedule.
What happens if you miss a Michigan filing or payment
A missed Michigan return or payment should be handled promptly. An unfiled return is not resolved simply because the marketplace collected tax on some sales; Treasury may still expect a return if you are registered and required to file. File any outstanding periods accurately, separate facilitated marketplace sales from reportable direct sales, and pay the amount properly due as soon as possible.
Late filing or late payment can result in interest and penalties under Michigan tax law. The amount and available relief depend on the facts, return period, tax type, payment history, and any action already taken by the Michigan Department of Treasury. Do not guess at the balance or ignore Treasury correspondence.
If you discover past Michigan inventory, missed nexus, or an incorrect reporting approach, gather marketplace transaction reports, direct-sales records, inventory-location data, exemption certificates, and prior returns before correcting the issue. Sales Tax Compliance USA can assess the exposure, communicate the filing plan clearly, and handle the operational work without treating compliance as a do-it-yourself software task.

Frequently asked questions
Do I need to collect sales tax on Amazon FBA sales in Michigan?
For taxable sales facilitated through Amazon’s marketplace, Amazon generally collects and remits Michigan tax as the marketplace facilitator. You may need to collect Michigan tax yourself on taxable direct sales if you have a Michigan collection obligation. Do not report Amazon-facilitated sales on your own Michigan return merely because you have a registration for separate direct sales.
Does Amazon FBA create nexus in Michigan?
It can. Michigan states that owning, renting, leasing, maintaining, or having the right to use tangible personal property physically located in Michigan can create nexus, and it identifies warehouse or storage use as a nexus-creating activity. FBA inventory in Michigan should be reviewed as physical-presence nexus even if Amazon collects tax on marketplace sales.
What is the Michigan sales tax rate?
Michigan’s statewide sales tax rate is 6%. The state also applies a complementary 6% use tax in applicable situations. Product exemptions and transaction facts can affect whether tax applies.
Does Michigan have local sales tax?
No. Michigan has no city, county, or local sales tax. Taxable Michigan FBA sales use the single statewide rate rather than a combined state-and-local rate.
Does Amazon collect sales tax for Michigan sellers?
Amazon generally collects and remits Michigan tax on taxable sales it facilitates through its marketplace under Michigan’s marketplace facilitator law. That marketplace collection does not answer every seller-level compliance question, particularly if you hold inventory in Michigan or make direct sales. Review the marketplace reports and your other sales channels before deciding whether registration is needed.
Do I need a sales tax permit in Michigan for Amazon FBA?
If you only make marketplace-facilitated sales and the marketplace facilitator is required to remit Michigan tax for them, Michigan says you should not register and have no filing obligation. If you have taxable direct sales and Michigan nexus, you generally need a Michigan sales tax license. FBA inventory can be a nexus fact, so a mixed-channel seller should obtain a fact-specific review.
When does nexus begin for out-of-state sellers in Michigan?
Economic nexus is measured using the previous calendar year: it applies when gross Michigan sales exceed $100,000 or Michigan transactions reach 200 or more, including taxable and nontaxable transactions. Michigan directs sellers that meet a threshold during a year to register and begin collecting and filing in the following year. Physical presence, including inventory in Michigan, can establish nexus under a separate rule and should be assessed when it occurs.
What is marketplace facilitator law in Michigan?
Michigan requires a qualifying marketplace facilitator to collect, remit, and report tax on taxable sales it facilitates for marketplace sellers to Michigan purchasers, regardless of whether the marketplace seller has nexus. A marketplace seller should not report facilitated sales itself. However, marketplace sellers must include both facilitated and direct Michigan sales when determining whether they meet Michigan’s economic-nexus thresholds.
