Amazon FBA sales tax in Mississippi: A Practical Guide for Sellers

Mississippi Amazon FBA sellers need to separate Amazon marketplace orders from sales they make through their own website or other channels. Amazon generally handles Mississippi tax collection and remittance on taxable orders placed through its marketplace when it is responsible as the marketplace facilitator. That does not automatically settle your obligations for non-Amazon sales, inventory-related nexus, registration, or returns.

Mississippi’s Department of Revenue administers sales and use taxes, and sellers can register and file through its Taxpayer Access Point (TAP). The state’s remote-seller threshold is more than $250,000 in sales into Mississippi during a consecutive 12-month period. Mississippi also distinguishes its remote-sale use tax from in-state sales tax: the rates are set separately, so confirm the applicable current rate and your specific account obligations with the Department or a compliance professional before collecting.

How Mississippi sales tax applies to Amazon sellers

Mississippi taxes retail sales of tangible personal property unless a specific exemption or reduced rate applies. For an Amazon seller, the practical question is who made the sale and who is responsible for collecting the tax. Orders placed through Amazon’s marketplace are generally marketplace-facilitated sales; orders placed directly through your own store or another channel require a separate review of your Mississippi obligations.

Mississippi is not a home-rule state for sales-tax administration: local jurisdictions do not administer their own sales taxes independently. The Mississippi Department of Revenue is the state tax authority. A distinctive point for remote sellers is that Mississippi imposes use tax on remote sales, with a rate set separately from the in-state sales-tax rate. Do not assume the in-state rate is the correct rate for every remote transaction; verify the current rate applicable to your sales and registration.

Mississippi’s economic-nexus threshold and marketplace sales

An out-of-state seller with more than $250,000 in sales into Mississippi during any consecutive 12-month period meets Mississippi’s stated economic-nexus threshold for remote sellers. The Department of Revenue describes the obligation as registering to collect and remit Mississippi use tax. Track sales on a rolling 12-month basis rather than relying only on a calendar-year total.

Marketplace-facilitated sales are treated under Mississippi’s marketplace-facilitator rules, and the facilitator is responsible for collecting and remitting tax on covered marketplace sales. The Department’s marketplace-facilitator notice sets a $250,000 threshold for facilitators’ Mississippi sales. Because the treatment of marketplace sales in a seller’s own threshold calculation can depend on the applicable rule and the seller’s facts, do not count or exclude those sales based on an assumption. Ask the Department or have a compliance professional confirm the calculation for your business.

Does Mississippi FBA inventory create nexus?

Inventory stored in Mississippi can create physical presence and sales-tax nexus even if you do not own or operate the fulfillment center. The Department of Revenue identifies ownership of business property in Mississippi as a basis for nexus. Inventory held for your business in a fulfillment center may therefore require registration and collection on sales for which you, rather than a marketplace facilitator, are responsible.

Amazon may move inventory among fulfillment centers, and sellers may not control where stock is stored. Review inventory-location reports and shipment records, and confirm whether your inventory has been located in Mississippi and what obligations follow. Marketplace collection does not by itself resolve the registration question created by a seller’s own physical presence or other taxable activity.

What Amazon collects and what remains your responsibility

For taxable sales made through its marketplace, Amazon generally collects and remits Mississippi tax as the marketplace facilitator where the state’s rules make it responsible. The Department of Revenue’s marketplace-facilitator rules require qualifying facilitators to collect and remit tax on covered marketplace sales. Check your transaction reports to confirm which orders were marketplace sales and what tax was collected.

Amazon’s collection does not cover every transaction connected to your business. It does not automatically handle sales through your own website, invoices, or other marketplaces, nor does it determine whether your inventory or other activities require you to register. Keep marketplace and non-marketplace records distinct, and reconcile marketplace tax reports with your books rather than treating all Mississippi sales as already settled.

When and how to register through TAP

Register before making taxable sales for which Mississippi law requires you to collect tax. The Department of Revenue provides online registration for new sales and use tax accounts through TAP, its Taxpayer Access Point. Remote sellers subject to the economic-nexus rule generally need the appropriate Mississippi use-tax account; sellers with in-state activity should confirm whether a sales-tax permit or another account applies to their circumstances.

Prepare accurate business, ownership, contact, and activity information before starting the application. The right account type can depend on whether you are an in-state retailer, a remote seller, or a seller with inventory or other physical presence. If you are unsure which account to open or when collection should begin, confirm the current requirements with the Department or ask a compliance provider to review your facts.

Mississippi rates and taxable products

The Department of Revenue lists a general 7% rate for retail sales of tangible personal property, subject to statutory exemptions and reduced rates. Mississippi’s published rate schedule includes different rates for certain categories, including qualifying groceries and specified vehicles, equipment, and other products. The correct treatment depends on the product and transaction, so do not apply the general rate indiscriminately.

Mississippi’s remote-seller use-tax rate is set separately from the in-state sales-tax rate. The Department’s online-seller guidance and current rate information should be checked for the rate applicable to your remote sales; do not infer it from the general 7% in-state rate. Product taxability can also depend on whether an item is tangible personal property, a service, or a specifically exempt or reduced-rate item. Keep product descriptions and tax classifications current, and seek confirmation for unusual or bundled products.

Returns, filing frequency, and due dates

Mississippi sales and use tax returns are filed through TAP, and the Department requires a return for each assigned reporting period. Returns and payment are due on or before the 20th day following the end of the reporting period. If the due date falls on a weekend or holiday, the Department says the deadline moves to the next working day.

The Department bases filing frequency on annual tax remittances: annual filing applies when annual payments are less than $600; quarterly filing applies when annual payments are from $600 through $3,599; and monthly filing applies when annual remittances are more than $3,599. Your assigned frequency and account instructions control, so verify them in TAP. Filing and payment are separate steps in the online process; complete both by the deadline.

Sales outside Amazon and missed deadlines

If you sell to Mississippi customers through your own website, direct invoices, or another channel, Amazon does not collect tax on those transactions merely because you also sell on Amazon. If you have Mississippi nexus and make taxable sales, you may need to register, collect the applicable tax, file returns, and remit the amount due for those non-marketplace sales. The economic threshold, physical presence, product taxability, and the separate remote-use-tax rate all matter to the analysis.

The Department of Revenue warns that returns and tax must be filed and paid by the due date to avoid penalty and/or interest charges. If you miss a deadline, file and pay as soon as possible, even if you cannot pay the full balance, and contact the Department about your account and available next steps. Do not assume that a marketplace’s payment covers your own return or that a zero-tax period means no return is required; Mississippi requires returns for assigned periods, including periods with no liability.

Frequently asked questions

Does Amazon collect sales tax for sellers in Mississippi?

For taxable orders made through Amazon’s marketplace, Amazon generally collects and remits Mississippi tax as the marketplace facilitator where the state’s rules apply. That does not cover your direct website or other non-marketplace sales, and it does not automatically resolve your registration or return obligations.

Do Amazon FBA sellers need to register for Mississippi sales tax?

Some do. Registration may be required if you meet Mississippi’s remote-seller economic-nexus threshold or have physical presence, such as business inventory in Mississippi. Amazon’s collection on marketplace orders does not by itself determine whether you must register; confirm the account type and obligation for your facts with the Department of Revenue.

Does inventory stored in a Mississippi Amazon warehouse create sales-tax nexus?

It can. The Mississippi Department of Revenue identifies business property located in the state as a basis for nexus, and inventory held for your business may qualify. Review your inventory-location records and confirm the resulting registration and collection requirements.

What is the sales-tax threshold for Mississippi?

The Department of Revenue states that an out-of-state seller with more than $250,000 in sales into Mississippi during a consecutive 12-month period meets the remote-seller economic-nexus threshold. The resulting remote-seller obligation is generally to register and collect Mississippi use tax. Confirm how your marketplace transactions are treated in your threshold calculation.

Do marketplace sales count toward Mississippi’s economic-nexus threshold?

Marketplace-facilitated sales are subject to Mississippi’s marketplace-facilitator rules, under which the facilitator collects and remits tax on covered sales. The precise treatment of those transactions in a seller’s own threshold calculation should be confirmed for the seller’s circumstances; do not assume they are included or excluded without checking with the Department or a compliance professional.

Do I need to collect Mississippi sales tax on sales outside Amazon?

You may need to collect Mississippi tax on taxable direct or other-channel sales if your business has Mississippi nexus, including economic nexus or relevant physical presence. Amazon’s marketplace collection does not cover those separate transactions. The applicable remote-sale use-tax rate is set separately from the in-state sales-tax rate, so verify the current rate before collecting.

Do Amazon sellers still need to file a Mississippi sales-tax return?

A seller with a Mississippi tax account generally must file returns for each assigned reporting period, including periods with no liability, unless the Department instructs otherwise. Amazon’s remittance for marketplace orders does not automatically satisfy the seller’s own return obligation. Check your TAP account and filing instructions.

What is Mississippi’s sales-tax rate?

The Mississippi Department of Revenue lists a general 7% rate for retail sales of tangible personal property, with exemptions and reduced rates for specified categories. Remote sales subject to use tax are taxed at the same applicable Mississippi rate as sales tax, so the 7% general rate may not apply where an exemption or reduced rate governs. Verify the current rate for your product and sales channel with the Department.
