Amazon FBA sales tax in South Carolina: A Practical Guide for Sellers

South Carolina Amazon FBA sellers should separate two questions: who collects tax on an Amazon order, and whether the seller has South Carolina obligations of their own. Amazon collects and remits South Carolina sales tax on taxable sales made through its marketplace. But inventory stored in South Carolina can create physical-presence nexus for the seller, and sales through the seller’s own website may require the seller to collect and remit tax once the seller has nexus.

South Carolina’s general state sales tax rate is 6%, with applicable local taxes added to the rate for the delivery location. The South Carolina Department of Revenue (SCDOR) administers state and many local sales taxes; sellers register and manage filings through MyDORWAY. South Carolina is not a home-rule state for local sales tax administration. Its local-option taxes are county-specific, and special rules cap tax on certain large purchases, including vehicles.

When South Carolina sales tax nexus applies

Nexus is the connection that can require a business to register, collect tax, file returns, and pay tax to South Carolina. The SCDOR says physical presence in the state creates sales tax nexus. For an online seller, relevant activities can include having inventory stored in South Carolina, operating a business location there, or otherwise having people or property in the state in connection with the business.

A seller without physical presence can still have economic nexus. South Carolina’s remote-seller test looks at gross revenue from sales delivered into the state during the current or previous calendar year. If the threshold is exceeded, the seller must obtain a retail license and remit tax on taxable sales into South Carolina. Marketplace collection does not by itself settle whether the seller has nexus or whether the seller must collect tax on separate direct sales.

South Carolina’s economic nexus threshold

A remote seller has South Carolina economic nexus when gross revenue from tangible personal property, electronically transferred products, and services delivered into South Carolina exceeds $100,000 in the current or previous calendar year. The SCDOR’s threshold includes taxable and exempt sales, as well as wholesale sales of tangible personal property; it also includes covered products and services whether or not a particular sale is taxable.

Marketplace sales count toward the seller’s threshold calculation. Do not assume that Amazon’s collection and remittance removes those sales from the calculation: the SCDOR’s remote-seller guidance includes sales delivered into South Carolina, including sales made through a marketplace. Keep records that distinguish marketplace transactions, direct sales, exempt sales, and wholesale sales so the threshold can be monitored accurately.

How South Carolina inventory in FBA affects nexus

Inventory physically stored in South Carolina can create physical-presence nexus, even when the seller has no office or employees in the state. This matters for FBA sellers because inventory may be distributed among fulfillment locations. If your goods are stored in South Carolina, do not treat marketplace collection as a substitute for checking your own registration and filing responsibilities.

Amazon’s inventory placement can change, so review available inventory and fulfillment reports and retain records showing where stock was held and when. If you discover South Carolina inventory, or cannot determine whether it was there, confirm your position with the SCDOR or ask a sales tax service to review your facts. The exact registration and filing consequences can depend on your circumstances.

What Amazon collects and remits on marketplace sales

The SCDOR identifies Amazon as responsible for collecting and remitting South Carolina state and applicable local sales and use tax on taxable products sold through Amazon’s marketplace, including third-party products sold through the marketplace. That answers the marketplace-order question: Amazon handles the tax collection and remittance for those covered marketplace sales.

This does not automatically cover sales made through your own website, phone, or other channels. Nor does marketplace collection erase a seller’s possible nexus, retail-license, or return obligations. Review marketplace tax reports and reconcile them with your own records; report and pay tax on direct sales when South Carolina law requires you to do so.

When and how to get a South Carolina retail license

A seller required to collect South Carolina sales tax must obtain a Retail License from the SCDOR. This includes a remote seller that meets the economic-nexus test and a seller whose physical presence, such as in-state inventory, creates nexus and requires collection. Amazon’s collection on marketplace transactions does not itself provide a retail license for your business or resolve obligations on your other sales.

Apply through MyDORWAY, the SCDOR’s online registration and tax service. The SCDOR states that a separate Retail License is required for each retail outlet. Check the current SCDOR instructions for the application details, license tax, and the date by which you must register; do not begin collecting or filing based on an assumption about your particular facts.

Collecting tax on your own website

If you have South Carolina nexus and make taxable sales to South Carolina customers through your own website, you generally must collect and remit the applicable South Carolina sales tax on those direct sales. A seller that meets the remote-seller economic-nexus standard is responsible for tax on its taxable sales into the state, including sales through its website, catalog, or telephone operation.

Amazon’s marketplace collection applies to covered marketplace transactions, not automatically to orders placed directly with your business. Track direct and marketplace sales separately, determine which direct transactions are taxable, and apply the rate for the delivery location. If you are unsure whether your activities create nexus or whether a product is taxable, confirm the treatment with the SCDOR or have a service review your sales and fulfillment records.

South Carolina rates and local taxes

The general South Carolina state sales and use tax rate is 6%. The total rate on an order can be higher when a county or other applicable local tax applies. South Carolina adds local-option taxes by county, so the customer’s delivery location—not simply the seller’s address—matters when determining the rate.

South Carolina is not a home-rule state for local tax administration: the SCDOR administers and collects most local sales and use taxes on behalf of local jurisdictions. Use the SCDOR’s current rate and jurisdiction information to determine the combined rate for each delivery address. Special tax treatment applies to certain transactions, including maximum-tax items such as vehicles; do not apply the ordinary rate mechanically to a purchase that may qualify for a cap.

Filing and paying South Carolina sales tax

Registered sellers file and pay through MyDORWAY. South Carolina state and applicable local sales and use taxes administered by the SCDOR are reported together on the relevant return. The SCDOR states that returns are generally due by the 20th day of the month following the period in which the sales occurred; for example, a monthly return for November sales is due December 20.

Remote sellers licensed with the SCDOR are generally required to file monthly. Other filing arrangements may depend on SCDOR approval and the seller’s assigned filing frequency, so follow the frequency shown in your account and current SCDOR instructions. File a return for each required period, including periods with no sales if the SCDOR requires a return, and reconcile marketplace-collected tax separately from tax you collected yourself.

Deadlines, late charges, and penalties

Missing a filing or payment deadline can lead to penalties and interest. The SCDOR’s administrative guidance describes a failure-to-file penalty of 5% of the tax due for each month, or fraction of a month, that a return is late. Interest may also apply when tax is not paid; the applicable interest rate can change, so check the current SCDOR information rather than relying on an old calculation.

Do not assume that a late return has no consequence because Amazon collected tax on marketplace orders. Your own return may still be required for direct sales or other obligations. If you have missed a deadline, file and pay as soon as possible and contact the SCDOR or a qualified compliance service to review the account and any available next steps.

How to check where Amazon stores your inventory

Review your seller account’s inventory and fulfillment reports for inventory by fulfillment center or location, and retain copies of reports that show where units were stored. Report names and account navigation can change, so use Amazon’s current seller-account help materials to locate the relevant inventory-location information. A shipment destination alone may not establish every location where inventory was later held.

If the reports do not clearly identify the state, ask Amazon support for clarification and preserve the response. If you cannot confirm whether inventory was stored in South Carolina, treat the question as unresolved rather than assuming there was no in-state stock. The SCDOR can clarify the tax treatment of your facts, and a done-for-you compliance service can help review inventory records, nexus, registration, and filing needs.

Frequently asked questions

Does Amazon collect and remit sales tax for South Carolina FBA sales?

Yes. The SCDOR identifies Amazon as responsible for collecting and remitting South Carolina state and applicable local tax on taxable products sold through its marketplace, including third-party products. This does not automatically cover your own website or other direct sales.

Do Amazon FBA sellers need a South Carolina retail license?

A seller that has South Carolina nexus and is required to collect tax must obtain a Retail License from the SCDOR, including a seller with qualifying in-state inventory or economic nexus. Amazon’s marketplace collection does not itself give your business a license or settle obligations on non-marketplace sales. Confirm your facts and register through MyDORWAY when required.

Does Amazon storing inventory in South Carolina create sales tax nexus?

It can. The SCDOR says physical presence in South Carolina creates sales tax nexus, and inventory stored in the state can establish that presence. Check your inventory records and confirm the consequences for your business with the SCDOR.

Do Amazon marketplace sales count toward South Carolina’s economic nexus threshold?

Yes. South Carolina’s remote-seller threshold includes gross revenue from sales delivered into the state, including marketplace sales. Amazon’s collection and remittance on marketplace orders does not mean those sales should be excluded from your threshold tracking.

What is South Carolina’s economic nexus threshold for remote sellers?

A remote seller exceeds the threshold when gross revenue from sales delivered into South Carolina exceeds $100,000 in the current or previous calendar year. The calculation includes taxable and exempt sales and wholesale sales of tangible personal property. Check the current SCDOR guidance for your specific transactions.

Do I need to collect South Carolina sales tax on sales through my own website?

If you have South Carolina nexus and make taxable direct sales to South Carolina customers, you generally must collect and remit the applicable tax. Amazon’s marketplace collection does not cover orders placed directly with your business. The exact result depends on your nexus and the products or services sold.

What is the sales tax rate in South Carolina?

The general state rate is 6%, and applicable local taxes can increase the combined rate based on the delivery location. South Carolina also has special rules for certain transactions, including maximum-tax items such as vehicles. Check the SCDOR’s current rate information for the specific address and product.

How can I find out whether Amazon stores my inventory in South Carolina?

Review your seller-account inventory and fulfillment reports for inventory by location, and retain the reports. If they do not clearly show the state, ask Amazon support for clarification and keep the response. If you cannot verify the location, ask the SCDOR or a compliance service to review the records and your nexus position.
