Utah Amazon FBA sellers may need a Utah sales tax license and may have to collect tax on sales they make outside Amazon. Utah nexus can arise from economic activity or from a physical presence such as inventory stored in the state. Amazon’s collection of tax on marketplace orders does not, by itself, settle your registration or filing obligations.
The Utah State Tax Commission administers sales tax, and businesses register and file through its Taxpayer Access Point (TAP). Utah is a member of the Streamlined Sales and Use Tax Agreement, is not a home-rule state for local sales tax administration, and applies a lower combined rate to grocery food than to prepared food. The details that matter for your business depend on your sales channels, inventory, and assigned filing status.
When Utah sales tax nexus applies to FBA sellers
Nexus is the connection that can require a business to register, collect and remit Utah sales tax, and file returns. The Utah State Tax Commission identifies both economic and physical-presence grounds for nexus. For an FBA seller, the practical questions are whether Utah customers generate enough sales to meet the economic threshold and whether the business has inventory or another qualifying presence in Utah.
Utah’s nexus rules also cover certain business activities, including having or using a place of business in the state, regularly soliciting orders in specified circumstances, and regularly delivering property in Utah other than by common carrier or U.S. mail. Review your own facts rather than assuming that selling only online, or using a marketplace, removes every possible nexus obligation.
Utah’s economic nexus threshold and marketplace sales
The Utah State Tax Commission states that a seller has economic presence when sales of tangible personal property, electronically transferred products, or services for storage, use, or consumption in Utah exceed $100,000 during either the current or prior calendar year. The Commission’s marketplace guidance also uses a more-than-$100,000 Utah sales threshold for marketplace facilitators.
Marketplace sales are relevant to the threshold analysis: Utah’s marketplace guidance describes facilitator obligations in terms of sales made or facilitated in Utah, and marketplace sellers should not assume that marketplace transactions are irrelevant when assessing their Utah activity. The seller’s own registration and collection duties still depend on its nexus and sales outside the marketplace. If your channel totals or treatment of facilitated sales are unclear, confirm the calculation with the Commission or have a compliance professional review it.
How Utah inventory can create nexus
Utah identifies maintaining a stock of goods in the state as a physical-presence basis for nexus. Inventory held in a Utah Amazon fulfillment center can therefore create a Utah connection even if you have no office, employees, or direct sales to Utah customers. Do not rely on the economic threshold alone when inventory may be located in the state.
To investigate inventory location, review the inventory and fulfillment reports available in your seller account, including reports showing where units are stored or distributed. Keep records of the locations and dates shown, and ask Amazon for clarification if the reports do not establish whether stock was held in Utah. The exact nexus consequences depend on your circumstances; confirm them with the Utah State Tax Commission or ask us to review your facts.
How to register for a Utah sales tax license
Businesses that have Utah nexus generally need a Utah sales tax license. Apply through the Utah State Tax Commission’s Taxpayer Access Point (TAP), using the business registration process. The Commission says new businesses estimate their sales and use tax liability during the application, and it assigns a filing status.
Have your business and ownership details, contact information, sales-channel information, and a reasonable estimate of Utah tax liability ready. Registration is not a substitute for determining which sales you must report or collect tax on. If you are unsure whether FBA inventory or your sales activity creates nexus, resolve that question before deciding whether to register.
What Amazon collects and remits for Utah orders
Amazon acts as a marketplace facilitator for qualifying marketplace transactions and collects and remits Utah sales tax on orders for which it is responsible under Utah law. That marketplace collection does not automatically cover your direct website, other marketplaces, or other sales channels. Check transaction-level records and marketplace tax reports to understand which orders Amazon handled.
A marketplace seller with a Utah sales tax license must still file Utah returns, but the Commission’s marketplace seller guidance says not to report sales made through a marketplace on those returns. Keep the marketplace reports and reconcile them with your own books. If you have direct or other non-marketplace sales, those may still need to be reported and taxed as applicable.
When and how to file Utah sales tax returns
Utah sales tax returns are filed electronically through TAP. The Utah State Tax Commission requires a return for every assigned filing period, including periods with no tax liability. A zero-sales or zero-tax period is not a reason to skip a required return.
For a licensed marketplace seller, the Commission’s guidance says marketplace-facilitated sales are not reported on the seller’s return. Report the sales and tax that belong on your account, including applicable non-marketplace activity, and follow the return instructions for the assigned period. Reconcile marketplace statements, direct-channel sales, exemptions, and tax collected before filing.
Utah filing frequency and deadlines
The Commission assigns filing status based on estimated liability for new businesses and reviews accounts annually. Businesses with annual sales tax liability below $50,000 may file quarterly, those with liability of $50,000 or more must file monthly, and those with liability of $96,000 or more must pay by electronic funds transfer. The Commission may assign or change your status, so use the filing frequency shown for your account.
Returns and payments are generally due on the last day of the month following the filing period. Quarterly due dates shown by the Commission are April 30, July 31, October 31, and January 31. If a due date falls on a Saturday, Sunday, or legal holiday, the due date moves to the next business day. Check TAP and the Commission’s current instructions for your account’s exact due date and payment method.
Late filing and payment penalties
Late filing or payment can result in penalties and interest. Utah’s published general information describes a failure-to-file penalty for a tax-due return, calculated as the greater of $20 or up to 10% of unpaid tax, depending on when the return is filed. It also describes a failure-to-pay penalty for tax not paid on time, and an additional penalty if a balance remains unpaid 90 days after the due date.
The amount that applies depends on the account, the tax due, and the timing of filing and payment. Do not treat these figures as a substitute for checking the current Commission instructions or a notice issued to your business. File and pay as soon as possible if you have missed a deadline, and contact the Commission or a tax professional about your specific balance.
Utah tax on sales outside Amazon
Amazon’s collection on marketplace orders does not discharge your responsibilities for sales through your own website, invoices, or other channels. If you have Utah nexus, you may need to collect and remit Utah tax on taxable non-marketplace sales delivered to Utah customers. The applicable rate depends on the delivery location and the product or service; Utah’s rate tools and taxability guidance should be used to determine the treatment.
Utah’s lower combined rate applies to grocery food, while prepared food is generally taxed at the full combined rate for the location. Product classification matters, so do not apply the grocery-food treatment to prepared food without checking the Commission’s definitions. Keep channel-level records so marketplace sales and your own sales are not confused when preparing returns.

Frequently asked questions
Does Amazon collect and remit sales tax in Utah?
Amazon collects and remits Utah sales tax on marketplace transactions for which it is responsible as a marketplace facilitator. This does not cover your direct website or other non-marketplace sales, and it does not automatically remove your own registration or filing obligations.
Do Amazon FBA sellers need a Utah sales tax license?
An FBA seller generally needs a Utah sales tax license if it has Utah nexus, which can arise from economic activity or physical presence such as inventory in the state. Marketplace-only sellers may have different registration obligations for facilitated sales, but nexus and non-marketplace sales can change the answer. Confirm your facts with the Utah State Tax Commission or have them reviewed.
Does inventory in a Utah Amazon fulfillment center create sales tax nexus?
Utah lists maintaining a stock of goods in the state as a physical-presence basis for nexus. Inventory held in a Utah fulfillment center can therefore create nexus even if you do not have a Utah office or employees. Confirm the inventory location and your specific obligations with the Commission.
How can I find out whether Amazon stores my inventory in Utah?
Review your seller-account inventory and fulfillment reports for storage or distribution locations, and retain records showing the locations and dates. If the reports do not clearly identify whether inventory was held in Utah, ask Amazon for clarification and consult the Utah State Tax Commission about the tax consequences.
What is Utah’s sales tax economic nexus threshold?
The Utah State Tax Commission states that economic presence applies when sales of covered property, electronically transferred products, or services for use in Utah exceed $100,000 during either the current or prior calendar year. Other forms of nexus, including Utah inventory, can apply regardless of whether you meet that sales threshold.
Do Amazon marketplace sales count toward Utah’s economic nexus threshold?
Utah’s marketplace guidance measures facilitator activity using sales made or facilitated in Utah, and marketplace sales should not be assumed irrelevant when assessing your Utah activity. The seller’s own collection and registration duties are a separate question, particularly for sales outside the marketplace. If your calculation is uncertain, confirm it with the Commission.
Do I need to collect Utah sales tax on sales outside Amazon?
If you have Utah nexus, you may need to collect and remit tax on taxable sales delivered to Utah customers through your own website or other channels. Amazon’s marketplace collection does not cover those transactions. Apply the correct tax treatment and location-based rate to each sale.
Do I still need to file Utah sales tax returns if Amazon collects the tax?
If you are registered and assigned a filing period, Utah requires a return for each period, including periods with no tax liability. The Commission’s marketplace seller guidance says licensed sellers do not report marketplace-facilitated sales on their returns, but applicable non-marketplace sales still need to be handled. File through TAP by your assigned deadline.
