SaaS and digital product sales tax in Texas: A Practical Guide for Sellers

Texas does not apply a simple “SaaS is taxable” or “SaaS is exempt” rule to every subscription. The Texas Comptroller of Public Accounts looks at what the customer receives and how the transaction is classified. Cloud-based products can involve taxable data processing, taxable telecommunications or other taxable services, while a digital product may be taxable when it is treated as taxable tangible personal property or a taxable service. The contract, functionality, billing structure and customer use can therefore matter.

For an online or cross-border seller, Texas sales tax exposure usually begins with classification and nexus. A remote seller with total Texas revenue of $500,000 or more in the preceding 12 calendar months must generally obtain a permit and collect and remit Texas use tax, subject to the specific rules for marketplace sellers and other activities in Texas. Texas charges 6.25% state sales and use tax, with local taxes potentially increasing the combined rate to 8.25%. Sales Tax Compliance USA is a people-led, done-for-you service that can review your products, nexus, registrations, filings and remittances; the exact position depends on your circumstances and should be confirmed with the Texas Comptroller or checked with us.

Is SaaS taxable in Texas?

Texas does not publish a blanket rule that every SaaS subscription is taxable under one label. The Comptroller classifies the underlying transaction. A cloud product may include data processing, telecommunications, information, amusement or another taxable service, or it may contain elements that do not fit a taxable category. Calling a product “software,” “ SaaS” or “a subscription” does not by itself settle the tax result.

Data processing is especially important for digital businesses. Texas describes taxable data processing as computer-performed work using customer data, including entering, storing, manipulating, compiling, retrieving or producing information. A SaaS product that performs those functions for the customer may require a detailed review rather than an assumption that the subscription is exempt.

If your offering combines hosted access, storage, automated processing, support, implementation or professional services, separate the components where Texas rules require it. The exact tax treatment depends on the service actually supplied, the contract and the invoice. Confirm an uncertain classification with the Texas Comptroller of Public Accounts or have us review it before you decide how to charge customers.

Are digital products taxable in Texas?

Digital products do not all receive the same treatment in Texas. Taxability can depend on whether the customer receives tangible personal property, a taxable service, an information service, an amusement service or another category covered by the Texas Tax Code. A downloadable file, online content subscription, database, digital report, course, game or other product should be analyzed by its substance and delivery method.

Texas treats certain information services as taxable, including specified services such as newsletters, financial market reports, mailing lists and data retrieval or research. The Comptroller’s information-service rules provide a special taxable percentage for qualifying information services, so sellers should not automatically apply tax to the entire charge without checking whether the service fits that category and its requirements.

Digital content that is not clearly within a taxable category may have a different result from a digital service that processes customer data or provides interactive functionality. Keep a written classification analysis and preserve contracts, product descriptions and invoices. If the product is novel or bundled, ask the Comptroller or a tax professional to confirm the treatment rather than relying on a generic “digital goods” label.

How Texas classifies taxable digital services

Texas has a statutory list of taxable services in Tax Code Section 151.0101. The Comptroller identifies 16 broad categories, including data processing, telecommunications, cable television and amusement services. For digital businesses, the most relevant question is often whether the customer’s data is being entered, stored, manipulated, retrieved or converted by computer, because those activities can fall within taxable data processing.

The Comptroller gives examples of taxable data processing that include data storage, data conversion, editing customer data, producing reports from customer data, online form and payroll processing, transcription, scanning and similar computer-performed work. A product that merely delivers content may need a different analysis from one that performs operations on customer data.

Texas also distinguishes taxable and nontaxable components in a mixed contract. The Comptroller states that a taxable service should be separately billed when it is part of a contract containing nontaxable services, and the charge must be reasonable. For a digital business, that means product design, implementation, consulting, support, storage and processing should be mapped to the actual services supplied instead of being hidden under one broad subscription description.

When does a remote seller have Texas sales tax nexus?

A remote seller is an out-of-state seller whose only Texas activity is remotely soliciting sales. Texas provides a remote-seller safe harbor based on gross Texas revenue from the preceding 12 calendar months. The calculation includes taxable and nontaxable sales of tangible personal property and services into Texas, sales for resale, sales to exempt entities, and separately stated handling, transportation, installation and similar fees collected from customers.

A remote seller with Texas revenue of $500,000 or more in the preceding 12 calendar months must generally obtain a Texas sales and use tax permit and collect and remit Texas use tax. Collection must begin no later than the first day of the fourth month after the month in which the seller exceeds the threshold. A seller with employees, inventory, property, agents or other Texas activity may have obligations based on being engaged in business in Texas even when the remote-seller threshold is not the only issue.

A seller operating only through a marketplace provider may have a different responsibility when the marketplace provider certifies that it is collecting and reporting tax on the seller’s behalf. Do not treat marketplace activity as a universal exemption: review your own direct sales, Texas presence, marketplace arrangement and revenue calculation.

What Texas sales tax threshold applies to online sellers?

The Texas remote-seller threshold is $500,000 of total Texas revenue in the preceding 12 calendar months. It is not limited to taxable sales. Texas includes gross revenue from taxable and nontaxable tangible personal property and services, sales for resale, sales to exempt entities, and separately stated handling, transportation, installation and similar fees.

The threshold is a rolling lookback, not a once-a-year test. Monitor Texas revenue each month and retain the calculation supporting your conclusion. If the threshold is exceeded, Texas states that the seller must obtain a permit and begin collecting and remitting no later than the first day of the fourth month after the month of exceeding it.

Below the safe harbor, the result can still change if the seller has Texas physical presence or another form of Texas business activity. The threshold also does not answer whether an individual product is taxable. Nexus and product taxability are separate questions that should be reviewed together.

How to register for a Texas sales tax permit

The Texas Comptroller of Public Accounts administers Texas sales and use tax. A seller can apply through the Texas online sales tax registration application or submit Form AP-201, Texas Application for Sales and Use Tax Permit. The Comptroller also provides registration instructions for remote sellers located outside the United States.

Before applying, assemble the business’s legal name, ownership information, business addresses, responsible-party details, product descriptions, expected Texas activity and marketplace information. Select the relevant business activities accurately. A permit application does not replace the need to determine whether SaaS, digital products or related services are taxable.

After approval, the Comptroller notifies the taxpayer whether returns must be filed monthly, quarterly or yearly. Keep the permit information, filing frequency notice and registration records with your tax files. Sales Tax Compliance USA can handle the practical registration process and coordinate the classification and nexus review, but the final legal position remains dependent on the facts and current Texas rules.

How Texas sales tax rates and local taxes are calculated

Texas imposes a 6.25% state sales and use tax on retail sales, leases and rentals of most goods and on taxable services. Cities, counties, special-purpose districts and transit authorities may impose local sales and use taxes of up to an additional 2%, making the maximum combined rate 8.25%.

Texas is not a home-rule state for sales-tax administration in the sense relevant here: local jurisdictions do not independently administer the seller’s entire sales-tax compliance process. The Texas Comptroller administers the state system while local jurisdictions impose their authorized local taxes. Use the Comptroller’s Sales Tax Rate Locator and sourcing rules rather than relying on a customer’s billing address alone.

Texas offers remote sellers a single local use tax rate as an alternative to tracking every local jurisdiction. The current single local use tax rate for 2026 is 1.75%, and a seller electing it must notify the Comptroller using Form 01-799. This option applies to eligible remote-seller use-tax collection; it should not be assumed to replace address-based sourcing for every seller or every transaction.

How Texas taxes bundled SaaS and digital products

Bundling does not automatically make every component taxable or exempt. Texas examines the taxable service supplied and how the transaction is billed. A SaaS subscription that includes data processing, storage, content, support, implementation or consulting may need component-by-component treatment.

The Comptroller’s data-processing guidance says that when a contract includes taxable and nontaxable services, the taxable service should be separately stated and the charge should be reasonable. If taxable services exceed 5% of the overall contract price and are not separately identified, the total charge can become taxable under the Comptroller’s stated rule. If the taxable service is 5% or less and is not separately identified, the Comptroller’s guidance provides a limited treatment for that situation.

Do not manufacture artificial allocations. Use commercially supportable prices, describe deliverables clearly and keep evidence for the allocation. If the bundle includes a digital information service, data processing or another listed taxable service, obtain a Texas-specific review before applying a uniform tax setting to all customers.

Texas sales tax filing deadlines and remittance

The Comptroller assigns a filing frequency and notifies the taxpayer whether returns are monthly, quarterly or yearly. Monthly returns are due on the 20th day of the month following the reporting month. Quarterly returns are due April 20 for January through March, July 20 for April through June, October 20 for July through September, and January 20 for October through December. Yearly returns for the previous year are due January 20.

If a due date falls on a Saturday, Sunday or legal holiday, the next working day is the due date. File the return even when there is no tax due if the Comptroller requires a return for that period. Remit the tax collected and report taxable sales, exempt sales, deductions and other required information using the assigned filing method.

Businesses that meet the Comptroller’s electronic-payment requirement must use the TEXNET system under the applicable timing rules. The Comptroller states that taxpayers are notified when they meet the electronic-payment threshold. Check the current filing frequency, payment instructions and due date on the Comptroller’s site before each filing cycle.

Penalties and risks of Texas sales tax noncompliance

Under-collecting tax can leave the seller responsible for tax that should have been charged, in addition to applicable interest and penalties. Late registration, late filing, late payment, inaccurate returns, unsupported exemption claims and incorrect sourcing can each create exposure. A seller may also face a review of prior periods when its product classification or nexus position changes.

Digital businesses should preserve revenue-by-state calculations, product and contract descriptions, customer exemption documentation, marketplace records, invoices, sourcing data and filed returns. A defensible file helps explain why a subscription, digital product or bundled service was treated a particular way.

Do not wait for an audit notice to investigate an error. Reconcile Texas transactions, correct the classification or registration issue, and ask the Comptroller or a qualified compliance service about the appropriate remediation process. Sales Tax Compliance USA provides human-led registration, filing and compliance support; it does not promise that an audit or assessment will never occur.

Texas sales-tax treatment and compliance decisions for SaaS, digital products and remote sellers

Issue Texas rule or decision point Practical action
SaaS and cloud subscriptions No single blanket SaaS rule; classification depends on the services supplied, including possible taxable data processing or other listed services. Map each product feature, contract promise and invoice line to a Texas tax category.
Digital products Treatment depends on whether the transaction is tangible personal property, a taxable service, an information service, amusement or another category. Review downloads, memberships, reports, games and interactive functionality separately.
Remote-seller threshold $500,000 or more of gross Texas revenue in the preceding 12 calendar months generally requires a permit and collection of Texas use tax. Track taxable and nontaxable Texas revenue, resale and exempt sales, and separately stated related fees.
State and local rate The state rate is 6.25%; local taxes may add up to 2%, for a maximum combined rate of 8.25%. Use the Comptroller’s rate locator or assess eligibility for the remote-seller single local use tax election.
Single local use tax option Eligible remote sellers may use the current single local use tax rate instead of tracking every local jurisdiction; the 2026 rate is 1.75% and Form 01-799 is required to elect it. Confirm eligibility and file the election with the Comptroller before using the method.
Filing frequency The Comptroller assigns monthly, quarterly or yearly filing frequency. Use the assigned frequency: monthly returns are due on the 20th of the following month; quarterly and yearly dates follow the Comptroller schedule.
Bundled services Taxable and nontaxable services may require reasonable separate billing; the Comptroller’s data-processing guidance includes a 5% rule for certain mixed contracts. Document commercially supportable allocations and avoid a single tax treatment for an unexplained bundle.
