The Short Answer for Etsy Sellers

Etsy is the most international-seller-friendly U.S. marketplace. Unlike Amazon FBA and Walmart WFS (which store your inventory in U.S. warehouses and create physical nexus), Etsy has no U.S. warehouses or fulfilment infrastructure. Sellers ship every order from their own location.

For a cross-border Etsy seller in South Africa, the UK, EU, India or anywhere outside the U.S., this means:

  • No physical nexus in any U.S. state from Etsy alone โ€” you ship from your home country, not from a U.S. warehouse
  • Etsy collects + remits sales tax in all 45 sales tax states + DC as a marketplace facilitator
  • You typically do NOT need to register for U.S. sales tax in any state if Etsy is your only U.S. channel

The exceptions are 6 states that include marketplace sales when measuring direct-seller economic nexus thresholds: Texas, Ohio, Nevada, New Jersey, Michigan, Hawaii. Etsy as a Marketplace Facilitator (2026)

Etsy has been a marketplace facilitator since the 2019โ€“2020 rollout of state marketplace facilitator laws. As of 2026, Etsy collects and remits sales tax on Etsy Payments sales to U.S. buyers in all 45 sales tax states plus the District of Columbia.

Practical effects:

  • Etsy calculates the correct sales tax at checkout based on the customer’s destination address
  • Etsy collects the tax from the buyer at the point of sale
  • Etsy remits the tax to each state’s Department of Revenue on the state’s filing schedule
  • Sellers don’t see the tax flow through their accounts โ€” Etsy handles it directly
  • Etsy provides sales-by-state CSV reports for sellers who want to track their U.S. activity

Etsy’s marketplace facilitator collection covers only Etsy Payments sales. If you accept payment outside the Etsy platform (custom invoicing, off-platform PayPal, etc.), you are the seller of record on those transactions and are responsible for sales tax yourself.

When Etsy Sellers Still Need State Registration

Six states include marketplace facilitator sales when measuring economic nexus thresholds for direct-seller registration purposes:

  • Texas โ€” $500,000 threshold; marketplace sales count
  • Ohio โ€” $100,000 OR 200 transactions; marketplace sales count
  • Nevada โ€” $100,000 OR 200 transactions; marketplace sales count
  • New Jersey โ€” $100,000 OR 200 transactions; marketplace sales count
  • Michigan โ€” $100,000 OR 200 transactions; marketplace sales count
  • Hawaii โ€” $100,000 OR 200 transactions; marketplace sales count (lowest revenue threshold makes HI surprisingly easy to trigger)

If your Etsy sales into any of these states (even with no other U.S. channel) cross the threshold, you must register for sales tax in that state. You’ll typically file zero-tax marketplace returns periodically โ€” Etsy already collected the tax โ€” but the registration itself is mandatory.

For most cross-border Etsy sellers, this only matters if your Etsy U.S. sales are large (typically $200K+ per year overall) and concentrated enough in one of these six states to cross the threshold. Lower-volume Etsy sellers usually have zero registration obligations.

  • Amazon FBA contributes 15โ€“25 physical nexus states from inventory storage
  • Shopify contributes 5โ€“15 economic nexus states from direct sales volume
  • Combined nexus footprint: typically 20โ€“35 states

The compliance work is dominated by the FBA + Shopify combination. Etsy is essentially a ‘free rider’ on the registrations you already need for the other channels.
